Assess your qualifications and proposed work
EB-2 covers advanced-degree professionals and people of exceptional ability. The NIW is part of EB-2, not a separate visa, and may allow self-petition.
Substantial merit
The proposed endeavor must have substantial merit and national importance.
Well positioned
You must show you are well positioned to advance the work.
Balance of benefit
The U.S. must benefit from waiving the job offer and labor certification.
What to bring
Résumé, qualifications, publications, evidence of impact and a clear description of the work you intend to pursue. A master’s degree alone does not qualify.
Proposed legal fee
NIW I-140 $8,000–$15,000; EB-2 PERM $5,000–$8,000 plus I-140 $3,000–$5,000. Government charges and screening are separate.
Is the NIW a separate visa?
No. It is part of EB-2, and you must also qualify for the underlying EB-2 classification.
